Client is responsible for: providing accurate timeline; ensuring venue permits amplified music; disclosing sound restrictions; designating point-of-contact for ceremony cues.
Licensing: DJ holds current ASCAP, BMI, and SESAC licenses for public performance of copyrighted music.

About this template

DJ and MC services contracts have specialized provisions beyond standard event-vendor agreements due to music licensing and equipment dependencies. Critical points: (1) Public-performance licensing - any DJ playing copyrighted music at a public or semi-public event must have current ASCAP, BMI, and SESAC public-performance licenses (combined annual cost ~$300-$700 for small operators). Asking the DJ for license proof is reasonable; uninsured DJs playing unlicensed music create venue exposure. (2) Equipment specifications - the contract should list specific gear models (speaker brand/wattage, mic types, mixer) so client knows quality level. Backup equipment is industry-standard - the second laptop, backup speaker, and spare cables prevent equipment-failure disasters at events. (3) Music selection process - good DJs use formal pre-event meetings to plan ceremony, cocktail-hour, and reception flow with client; the contract should reference this. Must-play and do-not-play lists are essential. (4) DJ retains musical-flow discretion - clients sometimes want to over-script every song; experienced DJs need flexibility to read crowd. (5) Venue requirements - power, table, access, sound restrictions matter. The DJ should specify venue requirements in writing so client can confirm. (6) Overtime rates - extending DJ time is the most common event-day issue; clear hourly overtime rate (often $200-$300) avoids disputes. State considerations: California, New York, and Texas have specific local-license requirements for amplified-music vendors; some venues require certificate of insurance from DJ. Disputes typically resolve in small-claims court ($5,000-$10,000 limit). Music-licensing infringement is rare in wedding context but can occur if DJ uses YouTube downloads instead of licensed sources.

What to include

  • Full party identification with DJ business credentials and licenses.
  • Event date, venue, and service type (DJ vs MC vs both).

  • Specific equipment (speakers, mics, mixer, lighting, backup).
  • Music-selection process and must-play / do-not-play lists.
  • Total fee with payment schedule and overtime rate.
  • Venue requirements (power, table, access).
  • Cancellation and rescheduling terms.
  • Public-performance licensing (ASCAP/BMI/SESAC).

Frequently asked

Yes, for public events. Under US Copyright Act §106, public performance of copyrighted music requires licensing from each performance-rights organization (ASCAP, BMI, SESAC, GMR). Annual blanket licenses for small DJ operators total $300-$700. Wedding venues may have venue-level licensing covering vendors, but most don't - the DJ's license is industry standard. Unlicensed performance creates exposure for both DJ and venue.
⚠ Legal disclaimer. DJ contracts intersect music-licensing law (ASCAP, BMI, SESAC, GMR public-performance licenses; Copyright Act §106) plus general event-vendor law. Verify DJ holds current PRO licenses before booking. Equipment specifications matter - speaker wattage and mic count drive event quality; clarify in writing. Overtime billing is event-night-common; clarity prevents disputes. State and local amplified-music ordinances apply (some California cities, NYC outdoor venues). For high-end events with complex production, consult an event-management attorney.
