DEFECT DESCRIPTION

On 2026-04-30, after 7 months of normal residential use (approximately 3-4 uses per week, all within the manufacturer's stated capacity and operating parameters), the blender motor failed during normal operation. Specifically:
  - Motor began making a grinding noise at startup.
  - Within 30 seconds, motor stopped responding to the speed selector.
  - Smoke briefly emitted from the motor housing.
  - Unit will no longer power on.
No abnormal use, no unauthorised disassembly, no modifications. The unit is well within the 2-year warranty period.

About this template

Warranty claims are governed by both the specific warranty document (express warranty) and broader background law. The federal Magnuson-Moss Warranty Act (15 U.S.C. ยง2301-2312) applies to consumer products costing $15+, requiring written warranties to be designated "Full" or "Limited" and prohibiting "tie-in" sales (you can use third-party parts/service without voiding warranty). UCC Article 2 implies warranties of merchantability (the product is fit for ordinary purposes) and fitness for a particular purpose (where the seller knew the buyer's specific use). State consumer-protection statutes (California Song-Beverly Consumer Warranty Act, New York General Business Law ยง198-a, others) often expand consumer rights. The most-effective claim letter cites the specific warranty (with attached terms), describes the defect specifically (date of failure, manner of failure, normal use), proposes a specific remedy (repair vs replace vs refund), and attaches receipt + warranty card + evidence of the defect. Manufacturers often initially deny claims for "user damage" or "out of warranty period" - both rebuttable with documentation. After the manufacturer's response, escalation options include: (1) state attorney general consumer-protection complaint (free, often effective), (2) Better Business Bureau filing (free, gets responses), (3) small-claims court (typical limits $5K-$25K), (4) Magnuson-Moss federal court action (requires informal dispute resolution if the warranty provides for one). Attorney-fee provisions in Magnuson-Moss and many state laws make warranty litigation viable on contingency for clear cases.

When to use it

  • Product fails within warranty period.
  • Manufacturer refuses to honour warranty claim.
  • Repeated failures of the same product.
  • Refusal of refund where warranty allows.
  • Implied warranty claim where express warranty is silent or expired.

What to include

  • Consumer identification and contact.
  • Product name, model, serial number.
  • Purchase date and location.
  • Specific warranty type invoked.
  • Defect description with date of failure.
  • Requested remedy.
  • Attachments: receipt, warranty card, photos.

Frequently asked

A federal law (15 U.S.C. ยง2301-2312) governing consumer-product written warranties. Key provisions: (1) written warranties must be designated "Full" or "Limited"; (2) tie-in sales clauses (must use authorised parts/service) are illegal unless the manufacturer provides parts/service free; (3) implied warranties cannot be disclaimed when an express warranty is given; (4) consumers can sue for breach with attorney-fee shifting in many cases. Applies to consumer products costing $15+.
โš  Legal disclaimer. Warranty law is governed by federal Magnuson-Moss Act (15 U.S.C. ยง2301), UCC Article 2 (state-by-state adoption), and state consumer-protection statutes (California Song-Beverly, New York GBL ยง198-a, others). State laws often expand consumer rights significantly beyond federal. For substantial claims or disputes that don't resolve through demand letter, consider small-claims court or consumer-protection attorney - many work on contingency or fee-shifting basis. Document all communications carefully.
