Critical legal framework: ESAs are governed by the Fair Housing Act (42 USC ยง3601), NOT the Americans with Disabilities Act (ADA). The distinction matters: (1) Service animals (ADA) are individually trained to perform tasks for a person with a disability; have full public-access rights (restaurants, stores, transit); typically dogs, occasionally miniature horses; (2) ESAs (FHA only) provide therapeutic comfort but are not task-trained; have housing-accommodation rights (no pet deposit, no breed restrictions in most cases) but NOT public-access rights; can be any animal. The 2021 Department of Transportation rule eliminated airline accommodation for ESAs (airlines now treat ESAs as standard pets), removing one of the major historical use cases. ESA letters must come from licensed mental-health providers (psychiatrist, psychologist, licensed therapist, licensed clinical social worker) - NOT from "online ESA letter" services that issue letters without genuine treatment relationship. HUD's 2020 guidance specifically devalued letters from non-treating online providers; many landlords now require letters from treating providers in the patient's residential state. The provider must have established a clinical relationship with the patient and made a genuine clinical judgment that the animal's presence alleviates symptoms. State law sometimes adds: California requires 30-day prior treatment relationship; some states have specific licensing requirements for ESA letter issuers. Misrepresentation of pets as ESAs (using fake letters) is a misdemeanor in some states (California, Colorado, others). Reasonable accommodation requests must be made in writing; landlords must provide accommodation unless they can show direct threat (e.g., aggressive dog with bite history) or undue burden. ESA letters typically need annual renewal.
